The Family Kennels Puppy Purchase Agreement Congratulations on your new puppy! The parents of your puppy are both excellent APBT’s. This litter was bred with the intent to better the APBT breed. Should you, the buyer, at any time prior to taking possession of your puppy should change your mind it shall be understood that any deposit paid shall remain on record to be used towards a purchase at any later date. Though non-refundable, any deposit shall remain valid indefinitely. As breeders, it is our hope that you will take exceptional care of this puppy throughout its entire life. This means providing socialization, medical, proper nutritional, physical needs as necessary, treating your dog as part of your family, and giving it lots of love for the remainder of its life. If for any reason you are unable to keep this puppy please contact us first. We will accept any of our offspring back. We do not repurchase or "buy back" dogs, but we do find new homes for them. Remember that environment and how it is raised has tremendous impact on how the dog will turn out. It is important that all APBT’s get obedience training at an early age. Buyer agrees to perform, or hire someone to perform training of the dog/puppy appropriate to the needs of the home. We stress the importance of leadership, guidance and training be provided to the puppy / dog by the new home. And again congratulations on your new puppy! 1. Breeder guarantees pup to be delivered in good health, current on vaccinations, and free of Distemper, Parvo, Parainfluenza, and any life threatening genetic defect. 2. All puppies will have a current health certificate from a licensed Veterinary Clinic. 3. Puppies will be dewormed at time of shipping or pick up, and a normal deworming should follow as recommended by your vet. Shots and dewormings are the responsibility of the buyer. Any pup that develops an illness related to lack of shots or deworming will NOT be replaced. It is the responsibility of the new owner to keep up with all vaccinations and health care. 4. Purchaser agrees to follow up with a Veterinary Clinic within 1 week of receiving the pup. At that time or within 5 years of birth, if it is determined by a qualified veterinarian that the pup is found to have any life or quality of life threatening genetic defect, we will replace the pup. We do reserve the right to ask for a second opinion on any findings by the said Vet. a. 5 YEAR GUARANTEE PET QUALITY: The Breeder guarantees that said puppy will be free of crippling hip dysplasia for up to (5) five years. Any puppy unable to function as a household pet due to canine hip dysplasia must be diagnosed as such by the OFA, or other qualified specialist. Buyer must present all documentation along with x-rays, and the said puppy/dog to the Breeder. When a puppy of equal value is available, replacement shall be made. 60 month replacement guarantee for genetic conditions that limit service capability (TFK reserves the right to have canine in question evaluated by a qualified veterinarian to validate any claim associated to this warranty) No refunds will be offered, any and all expense associated with shipping to be paid by buyer. b. 5 YEAR GUARANTEE SHOW/BREEDING QUALITY: The buyer understands that the seller cannot guarantee show winning animals. The breeder can only state an opinion as to show potential at the time of the sale. Said puppy is guaranteed not to have any disqualifying faults excluding size according to the ADBA Standard. If said puppy is disqualified from an ADBA conformation ring by two (2) different judges due to conformation and proof of such disqualification is presented to Breeder, said puppy shall be replaced with another show quality puppy for the price of a pet quality puppy. Said puppy is also guaranteed to qualify and receive and Orthopedic Foundation for Animals (OFA) certificate of “Fair” or better after presentation of the required x-rays that shall be provided by the Buyer at the age of 24-30 months of age. Should said puppy be denied such certificate due to canine hip dysplasia Breeder shall replace said puppy/dog with another show quality puppy. A deposit is required to hold any puppy under the age of 12 weeks. Deposits are $500.00. Puppies are required to be paid for in full by 12 weeks of age. If at 12 weeks of age the pup has not been paid for in full, you will forfeit your deposit. If you change your mind on a pup, your deposit may be transferred to any available pup at that time or pup from a future litter, however will not be refunded. Deposits are NON-REFUNDABLE. 6. If you are purchasing a blue coated pup, you should understand that blue coated dogs are more prone to skin and coat problems. This is simply the result of the blue coat coloring. We do NOT guarantee against skin or coat problems. We will not be held responsible for skin or coat problems that are common among dogs with blue coloring. (Note: Our dogs are not prone to skin problems.) 7. Purchaser agrees to prove a safe home for their new pup and will not use the pup for any illegal activity. If at any time, the purchaser is found to be using the pup for illegal activity, We reserve the right to regain possession of the pup. We do not tolerate dog fighting. If it is reported and confirmed that this dog is being abused or neglected by Purchaser, rights and ownership of the dog will automatically terminate and revert back to Breeder who may immediately assume possession of the dog. Including and not limited to Breeder or Breeder’s representative entering any property housing said dog to retrieve said dog. Breeder's reasonable fees for recovery of the dog will be paid by the Purchaser. Purchaser’s Initials__________ 8. Purchaser agrees to exercise normal care in maintaining this puppy's health. Routine preventative care includes the following: annual physical exams by a licensed veterinarian, annual vaccinations against DHLPP, continual heartworm prevention, and rabies vaccinations as mandated by the Purchaser's state and county of residence. Normal care assumes that the Purchaser will feed only recognized brands of dog food (not generic). If it is reported and confirmed that this dog is being abused or neglected by Purchaser, rights and ownership of the dog will automatically terminate and revert back to Breeder who may immediately assume possession of the dog. Including and not limited to Breeder or Breeder’s representative entering your property or any property housing said dog to retrieve said dog. Breeder's reasonable fees for recovery of the dog will be paid by the Purchaser. Purchaser’s Initials___________ 9. If at any time the purchaser can no longer provide for the pup, we will gladly accept the pup back. We do not want to see any of our dogs end up in shelters! By signing our agreement, you understand that if at any time you can no longer care for your dog, you are required to contact us to pick-up the dog. a. If at any time this puppy is to be sold or given away, the breeder is to be notified in writing by telephone & certified mail and given first option to get the puppy back . b. This dog is not to be placed in a shelter or humane society. Failure to follow this requirement will entitle Breeder to a monetary fine in the amount of $2,000, paid by Purchaser, as a result of breach of contract. Breeder's reasonable attorney's fees for recovery of the dog or collection of the fine will be paid by the Purchaser. Additionally, rights and ownership of the dog will automatically terminate and revert back to Breeder who may immediately assume possession of the dog, including and not limited to entering any property housing said dog. Purchaser’s Initials__________ 10. Purchaser acknowledges and agrees that this registration is a limited registration, unless noted in section 11 as a breeding quality dog. All offspring of purebred, registered parents are entitled to registration papers. However, in the event that the Purchaser does not have the puppy properly neutered/spayed, any offspring issuing from this pet-quality puppy are not eligible for registration with the ADBA, CKC, or UKC. 11. Breeding Rights are Available with this dog. Requires breeder signature.________________________________________ a. The Buyer agrees that this animal will not be used for breeding purposes to another APBT unless registered with the ADBA or other certified dog registry ( UKC, CKC) and only after it has passed the following criteria: 1.) Official certification for hips by OFA, OVC, Penn Hip, or equivalent. 2.) Current negative Brucellosis report from Veterinarian. 3.) All inoculations and worming up to date, 1 month previous to breeding. 4.) If male must be at least 16 months of age before breeding. If female must be at least 20 months of age before breeding. 5.) Any dog intended for breeding must not show any disqualifying traits, whether physical or temperament. 12. Should the Buyer breed the animal before ALL the requirements listed in this section are met, the Buyer acknowledges the Breeder’s right to execute their right to repossess the animal that this contract pertains to. If the animal in question is a bitch, the Breeder may also repossess any and all offspring derived from the breeding in question. There will be NO refund and it will be left to the Breeder’s discretion as to the placement of the animal and any of its offspring. There shall be no refund of purchase price for said dog nor will a puppy be given as replacement. If a show quality male is purchased, Breeder reserves the right to breed any female owned, co-owned or leased by the Breeder to said male at no charge, breeder agrees to pay shipping costs associated 13. We reserve the right to include our kennel name on the puppy registration paperwork. All puppies purchased from us MUST have the word The Family’s in the registered name. Buyer may use any CALL NAME. 14. Payments may be made with U.S.P.S. money orders, money gram, or western union. We will NOT accept any personal checks or money orders other than U.S.P.S. money orders. 15. If Applicable; The Buyer agrees NOT to start Schutzhund Bite / Protection Training of this animal, until it has reached a minimum of 14 months of age. For Weight Pull a minimum of 8 months of age is required. (Thus allowing the animal the physical as well as mental maturity level not to harm or damage the animal. The Buyer agrees that he/she is not acting as or in part of, an agent in the purchase of this puppy and that the Buyer will not sell this puppy or any of it’s progeny to any agent, pet store, or guard dog business. 16. This animal is sold with the understanding that it was to go to select homes, be socialized properly, and become a member of the family. Buyer understands that every puppy needs training and socialization. Buyer agrees to release and hold harmless Breeder for any and all liability, damages, or injuries, caused either directly or indirectly by Puppy to any person, animal, whether actual or legal, or to any property whether real or personal. Furthermore, Buyer assumes full liability for any damages or injuries, whether physical or mental, emotional or economic, caused by Puppy, to any person whether actual or legal, or to any property, whether real or personal, after receiving and acknowledging delivery and possession of Puppy. This contract shall be deemed a legal and binding agreement between Breeder and Buyer and is under the jurisdiction of the State of Minnesota in the county of Stearns. It is further agreed that should any dispute/arbitration between Breeder and Buyer regarding said puppy/dog occur that the legal venue shall be the County of Stearns, Minnesota. Any mutually agreed amendments to this contract shall be entered below this point of contract with initial of both parties. By signing this agreement, you understand what you have read, and understand that we do enforce this agreement 100%.
